Terms of use

The terms for using the NymForm website and the hosted NymForm for Excel alpha. Plain language, and separate from the AGPL-3.0 license that covers the source code.

The short version

  • These terms cover the NymForm website (nymform.com), its forms and docs, and the hosted NymForm for Excel alpha build we serve. They don't change the open-source license of the NymForm source code.
  • NymForm is alpha software for evaluation. Try it with synthetic or non-sensitive data. We make no promise that it is available, accurate, compatible with your setup, or free of faults.
  • You bring your own OpenRouter key and you decide what data you use. You review the exact request before it is sent and the formula before you rely on it.
  • The source code is free software under the GNU AGPL-3.0-only license. Nothing here limits what that license lets you do with the code.

Who provides this

The NymForm website and the hosted alpha build are provided by Jorge Garcia, doing business as Sky Span Marketing. In these terms, "we" means Jorge Garcia, doing business as Sky Span Marketing.

What these terms cover

  • The website at nymform.com, including the docs, the walkthrough video and the two forms.
  • The hosted NymForm for Excel alpha build that we serve for sideloading into Excel (the add-in manifest and task pane files), and any later hosted build we publish.

By using the website or the hosted alpha, you accept these terms. If you don't accept them, don't use them. Using the source code under its license needs no acceptance of these terms.

Alpha software, for evaluation

NymForm for Excel is alpha software. It is provided so you can evaluate it. It is not a finished product.

  • Use synthetic data, or data that isn't sensitive, to evaluate it. Don't use it on data you can't afford to expose or to have handled wrongly.
  • We don't promise that it is available, that it keeps working, that it is compatible with your version of Excel or your organization's configuration, that its results are correct, that its checks catch everything, or that it is free of faults or security problems. Its known limits are listed plainly in Alpha limitations and in the repository's SECURITY.md.
  • The hosted alpha has been through one acceptance run, in Excel for Mac with a synthetic workbook. That shows the workflow can run; it doesn't show that NymForm is fit for production use or for sensitive data. Excel for Windows and Excel on the web haven't been checked.
  • NymForm is a technical control, not a legal, security or compliance certification. Whether a use of it meets your legal or organizational requirements is your decision, and it depends on your data, your configuration, your provider settings and your review procedures. NymForm doesn't replace legal, security, privacy or institutional review.

Your key, your data, your review

  • Your own OpenRouter key. The add-in sends requests to OpenRouter with a key that you create and enter. We don't issue keys, and we don't see, store or pay for your requests. Your use of OpenRouter, and of the model providers it routes to, is under their terms, and you are responsible for the key, its spending limit and its settings (such as zero data retention).
  • What you send. You decide which range to use, which columns to mark private, which mode to use, and what question to type. Headers, sheet names, notes, counts and your question are sent as they are; in sample-rows mode, values in columns you don't mark private are sent as they are. Review the exact request on What gets sent before you choose Send.
  • What you rely on. Review a formula and the cells it writes before you rely on them. The formula check looks for functions and references it allows, not for whether the answer is right.
  • Your obligations. You are responsible for complying with the law, your organization's policies and any contractual or security requirements that apply to your data and to your use of AI services.

Acceptable use

Don't:

  • use the website or the hosted alpha in a way that breaks the law, or to process data you have no right to process;
  • try to interfere with the website, the forms, the hosted build or their hosting, for example by overloading them, probing for vulnerabilities in a way that damages or disrupts them, or bypassing security or rate limits;
  • misuse the forms: no automated or bulk submissions, no false or other people's details;
  • use the hosted build to attack other people or systems, or to distribute something harmful.

Nothing in this list limits what the AGPL-3.0 allows you to do with the source code, including studying, modifying, building and redistributing it, or running your own copy. If you find a security problem, please report it through the repository's private vulnerability reporting (opens external site), as its SECURITY.md describes.

Open-source license

The NymForm for Excel source code is licensed to everyone under the GNU Affero General Public License, version 3 only (AGPL-3.0-only). The license text is in the repository: LICENSE (opens external site). It gives you the right to use, study, change and share the code, on its conditions, and it comes with its own statements about warranty and liability, which these terms don't change.

These website terms are separate from that license. They cover the website and the hosted build we serve; they don't add conditions to the license, take away rights it grants, or apply to what you do with the source code under it. If anything in these terms seems to conflict with the AGPL-3.0 as it applies to the source code, the license applies to the code.

Other people's services

  • OpenRouter and model providers: requests from the add-in go to OpenRouter with your key, and OpenRouter passes them to the provider of the model you chose. Their terms and privacy policies apply. We don't control what they do with a request.
  • Microsoft Excel: NymForm runs inside Excel as an add-in. Microsoft's terms apply to Excel. Excel is a Microsoft trademark; NymForm is not affiliated with or endorsed by Microsoft.
  • GitHub: the source repository, its releases and the hosted build (served from GitHub Pages) are on GitHub, under GitHub's terms.
  • Vimeo: the walkthrough video plays from Vimeo after you press play, under Vimeo's terms. See the privacy notice.
  • Cloudflare: hosts this website and runs the forms' relay. See the privacy notice.

No warranty

The website and the hosted alpha are provided as they are and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the extent the law allows this. We don't warrant that they meet your requirements, are uninterrupted, timely or error-free, or that faults will be fixed. Some laws don't allow all of these exclusions, so some may not apply to you.

For the source code, the AGPL-3.0's own warranty disclaimer (sections 15 and 16 of the license) applies, and it is not changed by these terms.

Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the website or the hosted alpha, however caused. To the same extent, our total liability for all claims arising from the website or the hosted alpha is limited to one hundred US dollars (USD 100). Nothing in these terms excludes or limits liability that can't be excluded or limited by law, such as liability for fraud or for death or personal injury caused by negligence.

Names, logos and content

  • The text, design and images of the website belong to Jorge Garcia unless another owner is named. You may read, link to and quote from the website; don't republish its pages as your own.
  • "NymForm" is the name we use for the product. We claim no registered trademark in it. Use of the name to describe the software, including in a modified version's documentation, is fine, but don't present something else as NymForm or as endorsed by us.
  • Excel and Microsoft are trademarks of Microsoft Corporation. OpenRouter, GitHub, Vimeo and Cloudflare are the names of their respective companies. NymForm is not affiliated with or endorsed by any of them.
  • The NymForm source code is separately licensed under the AGPL-3.0-only; its copyright notice is in the repository's NOTICE file.

Changes and ending

  • We may change these terms. If we do, we'll update the date on this page. Changes apply from then on, not to what happened before. A material change will be noted on this page when it is made.
  • We may change, suspend or stop the website, the forms or a hosted build at any time, for example to publish a new build or to retire an old one. The source code stays available under its license regardless.
  • We may refuse or block access to the website or the hosted build for misuse under these terms.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, to the extent the law where you live allows this. If a mandatory consumer-protection law where you live gives you more rights, that law applies to you instead. If part of these terms is found invalid, the rest still applies.
